Agreed Policy

Revocation of Naturalized Citizenship

Naturalized citizenship may be revoked judicially in exceptionally serious cases such as fraudulent naturalization, treason or terrorism.

Position

Naturalized citizenship may be revoked in exceptionally serious circumstances, such as fraudulent naturalization, treason, terrorism or other narrowly defined conduct gravely prejudicial to the state.

Policy

  • Revocation must follow a judicial process.
  • Grounds must be defined by statute rather than vague executive discretion.
  • A high evidentiary standard and a right of appeal are required.
  • Fraud in the naturalization process is a direct ground for revocation.
  • Treason and terrorism may justify revocation.
  • Restore Europe favours the possibility of revocation in exceptionally grave cases even where statelessness might result.

Implementation note

Implementation note

International and European law place substantial restrictions on rendering a person stateless, and removal normally requires a receiving state legally able and willing to admit the person. This belongs to the constitutional order Restore Europe seeks, and would require treaty or constitutional change.

Every question in this catalogue carries a position. Entries marked Derived follow the direction of the manifesto without their implementation being fixed, and several name the legal or treaty change they would require. Positions are revised as the movement decides; the version and date above say which text you are reading.
