Deportation of Non-Citizen Criminal Offenders

A non-citizen convicted of a qualifying serious criminal offence should ordinarily lose the right to remain and receive a permanent re-entry ban.

Position

Citizenship and foreign residence are distinct statuses. Serious intentional criminal offending by a non-citizen may justify termination of residence after conviction through a fair criminal process.

Policy

  • Require a lawful criminal conviction before criminal deportation.
  • Serious violent crime, serious sexual offences, robbery, organized crime, terrorism, trafficking, serious drug distribution, serious fraud and comparable intentional offences presumptively trigger removal.
  • Repeated offending may justify removal even where individual offences are less serious.
  • Where imprisonment is imposed, removal ordinarily follows completion of the custodial sentence unless lawful earlier transfer is available.
  • Attach a permanent re-entry prohibition to qualifying criminal deportations.
  • Minor administrative or trivial offences do not automatically trigger permanent expulsion.
  • Naturalized citizens are governed by separate citizenship-revocation rules and are not treated as foreign residents unless citizenship has first been lawfully revoked.
  • Citizens may not be deported from their own country.

Implementation note

A lawfully resident foreign national currently benefits from procedural safeguards against expulsion under European human-rights law. Removal may also be barred where return would expose the person to prohibited ill-treatment. The intended model is therefore rapid after final conviction, but still legally reviewable where binding obligations require it.
